purchase and inheritance of real estate in Turkey

Under Turkish law the principle of mutuality is applied. According to article 35, Turkish land register law no. 2644, dated 22. Nov. 1934, foreigners may buy real estate, regarding interdictions by law and the mentioned principle of mutuality. In agreement with this regulation citizens of those foreign countries, which allow Turkish citizens to buy real estate in their country, have the right to acquire property in Turkey as well, except in areas, which are excluded by special laws. The British government concedes Turkish citizens the right of purchase real estate in the UK. Hence British citizens are allowed to do so in Turkey - subject to the above mentioned and following regulations.

REGIONAL RESTRICTIONS
By law no. 2644 foreigners are not allowed to purchase property at certain areas. And there are other areas, where you need a special permission by the council of ministers.

a. Areas, where foreigners are strictly prohibited to purchase real estate: According to article 87, village law no. 442, foreigners are not allowed to buy property within the village border. According to law no. 2565, concerning military prohibited zones, foreigners are not allowed to buy property within these areas. (Exception: it is possible to establish your Turkish company (Ltd./Inc.); incurring costs ca. 1.500 Euro; the purchase price of your property can be invested as subscribed capital.)

b. Areas, requiring official approval for purchase real estate to foreigners; According to article 87, law no. 2644, with special permission given by the council of ministers foreigners may buy real estate which is outside the village border and larger than 30 hectares (about 74 acres).

Inside municipal areas there are no restrictions in terms of quantity, value and kind of the property (plot of land, residential houses or business premises).

HOW TO COMPLETE THE PURCHASE?
Under Turkish law carrying out the purchase contract and its official registration can only be done by the land registry. The notary is not entitled to do so. Notaries may only transact the date of payment. Subsequently one has to frequent the land registry to register the actual sales action personally. This procedure also could be carried out by a notarially certified representative.

CHARGES AND TAXES
The land registry charges you 48 °/oo (48 per mille) of total purchase value.
Foreign buyers are not obligated to proof, foreign currency was imported and changed into TL to pay the purchase. Those who imported foreign currency and changed it at the bank, should get it registered at the land registry.

Proprietaries have to announce the value of their real estate to the municipal authorities. The property tax falls due annually. It will be figured out according to the announced value of property:
- residential houses 4 °/oo (per mille)
- business premises 5 °/oo
- properties 6 °/oo
- estates 3 °/oo


LETTING AND SALES
In Turkey foreigners may use their property on their own or let it to any other person. Landlords having proceeds higher than a certain amount (in 1993 this amount was determined at 6.000.000 TL), have to pay income tax. There is a certain allowable deduction on rent proceeds. Running costs like repairs, electric power, water etc. can be asserted and will lower the amount to pay duty on.
Rent proceeds on business premises can be deducted a flat rate of 25 % without proof on expenditure.
Income tax starts with 25 %.
Foreigners owning property in Turkey may sell it at any time to any person. It is legal to transfer the sales revenue to foreign countries.

REGULATIONS IN CASE OF DEATH / INHERITANCE
If a foreigner, owning property in Turkey, will die, the immovable will be endorsed on the heirs. Heirs need a certificate of inheritance, which is obtainable from the authorities at their place of residence. The Turkish court needs this certificate of inheritance to assign the bequest to the heirs. If they accept the inheritance, they have to pay death duty.

IMPORTING HOUSEHOLD UTENSILS TO TURKEY
1. Foreigners visiting Turkey for reasons of business, sciences and research or studies may temporarily import their used household utensils for at least two years. They have to post a bail. Ending the sojourns the household utensils have to be exported again and the bail will be refund.

2. Foreigners, migrating to Turkey may import their used household utensils temporally unlimited. For this purpose a residence permit is needed, which you can get from the govenor's office in the town you want to stay. The govenor's office will apply to the Turkish Home Office for a permit to take a residence in Turkey. After grant the mentioned permissions, the used household utensils may be imported.
